Accused nos.4 and 5 in Crime No.215 of 2026 registered by Byatarayanapura Police Station, Bengaluru City, for the offences punishable under Sections 140(2) & 311 of BNS, 2023 are before this Court in these two petitions filed under Section 483 of BNSS, 2023 seeking regular bail.

Heard the learned counsel for the parties.

FIR in Crime No.215 of 2026 was registered by Byatarayanapura Police Station, Bengaluru City for the aforesaid offences against Krish and others, based on the first information dated 19.06.2026 received from Sri Ravichandran S, who is the alleged victim in the present case. During the course of investigation, the petitioners, herein were arrested on 19.06.2026 and in remand application, they were arraigned as accused nos.4 and 5. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6286 of 2026 was rejected on 30.06.2026. Therefore, they are before this Court.

In the first information dated 19.06.2026 submitted by the alleged victim, he has stated that on 17.06.2026 at about 11.45 p.m, when he was returning home in his two wheeler, five persons who came in a autorikshaw, allegedly intercepted his motorcycle and thereafter, made him to sit in the autorikshaw forcibly and took him along with them. Two amongst the five followed the autorikshaw in his motorcycle. Subsequently, they took him to a under construction building and assaulted him for the reason that, earlier in the case of Chetan, he had got them assaulted. It is alleged that accused no.1 had snatched his mobile phone and earpod before escaping from the spot of crime. In respect to the alleged incident that had taken place on the night of 17.06.2026, belatedly, first information is submitted on 19.06.2026 at about 10.40 a.m. In the first information itself, it is stated that, after the incident had taken place, the first informant had returned home and subsequently, he went to the Victoria Hospital for treatment and thereafter, approached the police.

From the aforesaid, it is apparent that, the first informant had suffered only simple injury in the incident in question. He had personally appeared before the police station on 19.06.2026 and submitted his first information.

The petitioners herein are said to be persons with criminal antecedents and they have one case each registered against them for offence punishable under Section 307 of IPC. Insofar as the present case is concerned, allegation of snatching the mobile phone and earpod of the victim is only as against accused no.1. The other accused persons had assaulted him with hand for the reason that in case of Chetan, he had got them assaulted.

From the aforesaid aspects of the matter, I am of the opinion that, the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions.
