The present Writ Petition is filed by the petitioners seeking to declare the action of the respondents, more specifically the action of the 3rd respondent, in not disposing of the suspension/stay petition filed in Appeal, dated 13.04.2022 as illegal and consequently to direct the 3rd respondent to dispose of the said suspension /stay petition as early as possible.

Heard learned counsel for the petitioners and the learned Assistant Government Pleader.

The learned counsel for the petitioners submitted that the petitioners have filed Appeal, dated 13.04.2022, aggrieved by the proceedings, dated 14.03.2022, passed by the 4th respondent-Tahsildar and further he submitted that it is suffice to direct the respondents to dispose of the said appeal along with the stay petition.

The learned Government Pleader has fairly conceded for passing of the said order.

With the consent of both the parties, the Writ Petition is disposed of, at the admission stage, with a direction to the 3rd respondent to immediately take up the stay petition filed in the appeal and dispose of the same within a period of one week from the date of receipt of a copy of this order and thereafter, to dispose of the appeal, dated 13.04.2022, as per law, within a period of six weeks. No order as to costs.

Miscellaneous Petitions, if any pending, in this Writ Petition, shall stand closed.
