Judgment
P.Madhavan, Judicial Member This Original Application has been filed by the applicant seeking the following reliefs:
'' 1. Direct the respondents to consider granting pay parity to the post of Computer (DTP) in Lakshadweep Government Press on par with DTP Operators of Government of India Press.
2.Direct the respondents to extend the benefit of Annexure A3 to the applicant by sanctioning the revised pay scale as granted to Master Creftsman (DTP Operator) to the applicant w.e.f. The eligible date.
3.Direct the respondents to upgrade pay of the applicant on par with the DTP Operators of Government of India Press as at Rs.9300-34800 + GP Rs.4200/- w.e.f. the eligible date.
4.Any other further relief or order as this Hon'ble Tribunal may deem fit and proper to meet the ends of justice.
5.Award the cost of these proceedings.''
The brief facts of the case are as follows:
The applicant is presently working as Computer (DTP) in Lakshadweep Government Press at Kavaratti. The DPT Operators in Government of India Press has been sanctioned revised scale of Rs. 5000-8000, in terms of Ministry of Finance notification amending the CCS (RP) Rules (Annexure A4), which has been adopted and implemented by the Administrative Ministry, Ministry of Urban Development in respect of Master Craftsman (DTP Operators) in Government of India Press. The applicant has raised request for pay parity with that of DTP Operator in Government of India Press as nature of duty discharged by him in Lakshadweep Government Press is identical. As no action is taken, the applicant has approached this Tribunal praying for the aforementioned reliefs.
When the matter came up for admission hearing, counsel for the applicant submits that the applicant has given a representation for getting him pay parity vide Annexure A-5 representation and he will be satisfied if the said representation is properly considered by the respondents and a decision is taken by the Government within a time frame.
Counsel for the respondents has no serious objection in considering the representation.
In view of the above submission, respondent no.2 is directed to forward Annexure A-5 representation to respondent no.1 and respondent no.1 will consider and take a decision in the light of relevant studies and Pay Commission reports and pass a speaking order within a period of six months from the date of receipt of a copy of this order.
The Original Application is disposed of as above at the admission stage itself without going into the merits of this matter. No costs.
