Judgment
Heard Mr. B. Bal Reddy, learned counsel for the petitioner, Mr. B. Mayur Reddy, learned senior counsel appearing for Mr. Krishna Kishore Kovvuri, learned counsel for the respondent No.6, Mr. K. Laxmaiah, learned standing counsel for respondents No.2 to 4 - Cyberabad Municipal Corporation (CMC) and learned standing counsel for respondent No.5 - HYDRAA.
Learned senior counsel for the respondent No.6 submitted that one Althati Sujatha, obtained LRS Proc.No.HMDAL187369/LRS/ SKP/Plg/HMDA/2015-2016 dated 11.10.2017 in respect of Plot No.192/P of unapproved layout in Sy.No.95, Neknampur, Gandipet Mandal, Ranga Reddy District. The said Sujatha and one Althati Ramadevi executed registered sale deed bearing Document No.7290 of 2018 dated 14.06.2018 in favour of one Keesara Ravi Kumar, who, in turn sold the said plot in favour of one K. Namassivaya, under registered sale deed bearing Document No.2013 of 2021 dated 29.01.2021. The said Namassivaya obtained building permission vide permit No.21376/MANK/0040/2021 dated 04.03.2021. Later, Namassivaya sold the said plot again to Keesara Ravi Kumar under registered sale deed bearing Document No.10606 of 2023 dated 28.08.2023. Thereafter, Keesara Ravi Kumar sold the plot to Syed Bilal - respondent No.6 under registered sale deed bearing Document No.19086 of 2025 dated 04.11.2025.
Learned standing counsel for CMC submitted that building construction was undertaken by the respondent No.6, who is the purchaser of the said plot under registered sale deed dated 04.11.2025.
Learned counsel for the petitioner submitted that complaint dated 04.08.2026 has been submitted to the respondent authorities as the respondent No.6 is making unauthorized construction by encroaching park/open space in the layout in Sy.No.95, Neknampur Village, Gandipet Mandal, Ranga Reddy District.
In view of the above submissions, without going into the merits of the case, the writ petition is disposed of with a direction to the respondent No.4 to cause enquiry on the complaint of the petitioner dated 04.08.2026 regarding alleged unauthorized construction undertaken by respondent No.6 over park area in Plot No.192, Sy.No.95, Neknampur Village, Gandipet Mandal, Ranga Reddy District, by affording opportunity of hearing to the petitioner and respondent No.6 and pass orders, in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
