Judgment
This Original Application has been registered on the basis of letter dated 06.06.2023 received from the President of Swami Vivekanand Paryavaran Sanrakshan Sewa Sansthan, Village and Post Office Prasan Majra Kuiya Jhor Dera, Tehsil Kalpi, District Jalon, Uttar Pradesh. Grievance in the application is that there was an orchard in Gata No. 594 with 700 fruit bearing trees but now there is an attempt to put up a Solar Plant by the officials and in that process, the orchard may be destroyed.
Having regard to the grievance raised in the letter, we are of the opinion that, at the first instance, the grievance needs to be looked into by the competent authority at local level. It is more so because complete particulars have not been reflected in the letter petition.
Hence, at this stage, we dispose of the OA directing the District Magistrate, Jalon and DFO of the concerned area to consider the grievance of the applicant and ensure that if any Solar Plant is to be put up in the Orchard, then in that process there is no violation of environmental laws.
The OA is accordingly disposed of.
