Judgment
This MA has been preferred by the original petitioner for supply of the signals of the channels of the respondent to this petitioner and petitioner is ready and willing to deposit Rs. 4 lakhs before this Tribunal.
In view of this submission and having heard the counsel for the respondent, we hereby direct the respondent to supply the signals of the channels of the respondent to the petitioner upon deposition of Rs. 4 lakhs by this petitioner before the Registrar of this Tribunal through Bank Draft. The aforesaid amount shall be accepted by the Registrar of this Tribunal and will deposit the same in a Nationalised Bank as Fixed Deposit initially for a period of six months.
Counsel appearing for the petitioner submits that this amount will be deposited by tomorrow and, therefore, we hereby direct the respondent to supply the signals of the channels of the respondent to the petitioner within 24 hours.
Counsel appearing for the respondent submits that they may be permitted to carry out the audit of the petitioner's Digital Addressable System (DAS) within a week's time and if any fault is found out on the part of DAS, they will immediately disconnect the supply of signals.
We, therefore, direct the respondent to supply the signals of the channels of the respondent within 24 hours upon the deposition of aforesaid amount and the respondent is also permitted to carry out the audit of DAS of petitioner within a week's time and if the audit report is found non compliant to Schedule III of the Interconnection Regulations of 2017, the respondent is permitted to discontinue the supply of signals immediately.
Upon aforesaid observations and directions, this MA is hereby disposed of.
