Judgment
Notice in M.A. Counsel Ms. Payal Kakra accepts notice on behalf of the non-applicant/respondent and is seeking time to file reply. The reply shall be filed before the next date of hearing.
If the petitioner is depositing Rs. 25 Lakhs by way of Demand Draft before the Registrar of this Tribunal immediately, then the respondent shall start supplying the signals to the petitioner immediately.
Counsel appearing for the petitioner submits that if the aforesaid amount is deposited by 5 p.m. today, the signals may be directed to be supplied immediately after the deposition of the aforesaid amount. On deposition of the said amount the respondent shall start supplying the signals to the petitioner immediately.
The deposition of the said amount shall not be treated as admission of any facts by the respondent and the deposition of the said amount will be without prejudice to the rights and contentions of the parties to this litigation.
The Demand Draft should be payable to “Registrar TDSAT”. The Registrar shall accept the aforesaid amount and deposit the same in a Nationalized Bank in a Fixed Deposit initially for a period of six months. Copy of the receipt of the Fixed Deposit receipt shall be supplied to the counsel for the petitioner as well as to the respondent.
Looking to the urgency of this matter, this Broadcasting Petition along with present M.A. shall be listed under the same head on 11.11.2022.
