This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue an appropriate wit more in the nature of Writ of Mandamus declaring the action of the 1st Respondent in not granting NOC to the Petitioner institutions which is newly established and thereby disabling the Petitioner to submit the mandatory documents before 3rd Respondent where the last date for submission of the NOCs is 31-07-2024 despite knowing the fact that the 2nd Respondent already issued NOC (No Objection Certificate) vide proceedings dated 09-01-2024 as being arbitrary, illegal, unwarranted and violative of Articles 14 and 19 (1) (g) of the Constitution of India and consequently consider the representation of the Petitioners dated 19-07-2024 and issue pass such other order or orders…”
The present writ petition is filed challenging the action of the respondents in not granting NOC (no objection certificate) for establishment of the pharmacy colleges.
Sri B.Srinivasulu, learned counsel for respondent No.3 filed proceedings vide Memo No.2389456/H.E.-EC/2024 dated 26.07.2024, which forms part of the record. The proceeding that envisages that the issue is under examination before the competent authority and the same will the decided in due course.
In view of the same, the petitioners are directed to approach the 1st respondent for the relief claimed in the writ petition and the 1st respondent is directed to pass appropriate orders on the same day.
With the above said directions, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall also stand closed.
