IA 973 of 2021:- Counsel, Mr. Ismail Nasikwala appeared for the Applicant. Counsel, Mr. Pulkit Sharma appeared for the Operational Creditor and Counsel, Mr. Dinesh Jadhwani a/w Mr. Ashish Pyasi appeared for the Corporate Debtor. Counsel appearing for the Applicant in the present seeking impleadment as a party in the CP(IB) 1820 of 2017. The Applicant under on misconceived notion filed this Application claiming himself as Financial Creditor whereas the present Company Petition is filed under Section 9 of the IB Code by the Operational Creditor. Counsel appearing for the parties expressed their desire to withdraw the above IA. In view of the above submissions, IA 973 of 2021 is disposed of as withdrawn.
Counsel appearing for the Corporate Debtor and Operational Creditor seeks liberty to file settlement memo before the next date of hearing. In case parties fail to file settlement memo in the matter the Company Petition will be heard and Consequential order will be passed. At the request of the parties list the matter on 07.10.2021 for filing settlement memo in the Company Petition.
