Judgment
In this Original Applicant, the applicant has taken a plea that the Project Proponent i.e. M/s VA Tech Wabag Limited and Uttar Pradesh Jal Nigam, Construction & Design Services (C&DS) Ghaziabad in the course of execution of the linear project i.e. laying down of pipelines for distribution of sewage treated water at site 4 industrial area, Sahibabad, Ghaziabad are violating the environmental norms. Counsel for the applicant has submitted that the Project Proponent are illegally extracting the groundwater but no clear plea in this regard could be pointed out from the pleadings. The OA reflects that for violation of the Graded Response Action Plan (GRAP), Uttar Pradesh Pollution Control Board (UPPCB) has imposed penalty of Rs. 25, 00, 000/- on 02.11.2023.
If the Project Proponent is causing violation of any environmental norms or is creating any air pollution or damaging the green belt in the area, then the applicant is required to disclose the full details thereof. That apart we find that the UPPCB has already taken action for violation of the norms by the Project Proponent. Therefore, if any further violation is noticed by the applicant then he will be at liberty to approach the Member Secretary, UPPCB along with the full particulars. If such a complaint is filed by the applicant, Member Secretary, UPPCB will duly consider the said complaint in accordance with law and take expeditious action if violation of norms is found.
OA is accordingly disposed of.
