Judgment

In view of the fact that the appeal against the order dated 02.12.2009 passed by the Tehsildar, Kotranka, Budhal is pending before the Additional Deputy Commissioner with powers of Commissioner Agrarian Reforms, Kotranka, Rajouri, Mr. Navyug Sethi, learned counsel for the petitioner submits that the petitioner was not aware of the pendency of proceedings before the Additional Deputy Commissioner, Kotranka, Rajouri, as such, prays that the present petition be disposed of with direction to Additional Deputy Commissioner, Kotranka, Rajouri to conclude the proceedings within some fixed period of time.
Learned counsels for the contesting respondents are not averse to the prayer made by the learned counsel for the petitioner.
In view of this, the present petition is disposed of with direction to the Additional Deputy Commissioner with powers of Commissioner Agrarian Reforms, Kotranka, Rajouri to decide the appeal pending before him within a period of three months from the date of receipt of certified copy of this order.
The contesting parties shall render all possible assistance to the Additional Deputy Commissioner, Kotranka, Rajouri for expeditious disposal of the appeal and in the event any of the contesting parties fail to render assistance to the Additional Deputy Commissioner, Kotranka, Rajouri, then the Additional Deputy Commissioner, Kotranka, Rajouri shall be at liberty to proceed in accordance with law.
The amount that has been deposited by the official respondent in the Registry of this Court shall be kept in the FDR and the same shall be released after the decision of proceedings pending before the Additional Deputy Commissioner, Kotranka, Rajouri.
