The matter has been taken up through virtual Court proceeding.

The petitioner has challenged the order dated 06.12.2016, passed by the respondent no.3, the Director (Administration)-cum-Additional Secretary, Education Department, Government of Bihar, Patna, as contained in Annexure-P1.

It is submitted by learned counsel for the respondent-State that a counter affidavit dated 17.01.2018 has been filed on behalf of respondent no.3, the Director (Administration)-cum- Additional Secretary, Education Department, Government of Bihar, Patna wherein specific statement has been made in paragraph no.5 that since the petitioner has already been retired on 31.12.2016, hence, respondent no.3 has dropped the departmental proceeding vide Notification dated 24.11.2017, issued in Memo No 3, AA1-208/2016/772, as contained in Annexure-B to the counter affidavit.

In that view of the matter, the present application has now become infructuous. Accordingly, it is dismissed.
