Suresh Prasad vs State of Jharkhand and Others

Narendra Nath Tiwari, J.—The petitioner retired as Joint Commissioner, Commercial Taxes on 31-1-2012. After his retirement only the amounts of Group Insurance and GPF have been paid to him. According to the petitioner, he is entitled to get pension, gratuity and leave encashment, but the same have not been paid. By order dated 3.9.2012 the respondents were directed to release the pensionary benefits and other benefits within four weeks or to show-cause as to why the benefits have not been paid. In spite of the said order, amounts of dues have not been paid to the petitioner. On prayer of the respondents, two months further time was granted by order dated 31.10.2012. The writ petition is listed today after about three months.

When the case is called out, learned G.A. submitted that the respondents are in process and the final decision is likely to be taken within two weeks. On that ground, he prays for further two weeks'' time.

Learned counsel appearing on behalf of the petitioner opposed the prayer and submitted that in spite of allowing ample time, the respondents have not taken decision so far. They have been unnecessarily harassing the petitioner.

Having heard learned counsel and on assurance of learned G.A., two weeks'' time, as prayed for, is granted to take final decision on the petitioner''s claim.

If the final decision is not taken and placed before this Court by the next date the Secretary cum Commissioner, Commercial Taxes shall be personally present in the Court to explain the position. Put up this case on 21st February, 2013.
