Heard both the sides.
This bail application has been filed on behalf of Suresh Mochi who is in custody since 04.04.2025 in connection with Barwadih P.S. Case No. 95 of 2024 for the offence registered under Sections 406, 409, 420, 467, 468 and 471 of the IPC pending in the Court of J.M. 1st Class, Latehar, is pressed into motion.
The petitioner was an employee of Hitachi Cash Management Services Private Ltd. and the said company was entrusted with responsibility of collecting the cash from the railway station and to be deposited in the Bank. It is alleged that the petitioner was involved in misappropriation of Rs.16,10, 409/-.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has no role in the said misappropriation of fund. In the trial, four witnesses have been examined and only one witness is to be examined.
Learned counsel for the State has opposed the bail application and submitted that there is direct and specific allegation against the petitioner of committing criminal breach of trust. The trial is at its penultimate stage. It has come during investigation that the defalcation was made to the tune of Rs.1,87,33,659/-
Considering the facts and circumstances of the case, the prayer for bail of the petitioner, is hereby, rejected.
