The present interlocutory application has been filed by the petitioner for recalling the order dated 19.7.2012 passed by this Court in WPC No. 5734 of 2010. For the reasons stated in this application, this interlocutory application is allowed. Accordingly, Order dated 19.7.2012 is hereby recalled.

Heard the Learned Counsel for the parties.
From perusal of order dated 9.1.2012, it appears that this case was order to be heard along with S.A. No. 330/2006 under the heading "For Final Hearing" on 16.2.2012, but it appears that thereafter hearing of these cases have not taken place.
From perusal of order dated 23 December, 2010, it appears that further proceeding of Execution Case No. 21/2009, which is pending in the Court of learned Munsif I, Dhanbad has been stayed. Therefore, in view of the above proposition, this matter is required to be heard along with S.A. No. 330/2006 and in the meantime, ad interim order granted vide order dated 23.12.2010 is required to be continued.
Learned Counsel for the parties shall approach before the learned Joint Registrar (List & Computer) by filing appropriate application requesting therein to place both the cases before the appropriate Bench for hearing, if required, after obtaining the necessary order of Hon''ble the Chief Justice. Let this order be communicated to the lower court concerned, through FAX at the cost of the petitioner.
