Heard learned Advocate for the petitioner and the learned Advocate for the State.

The present application is filed for initiation of a contempt proceeding against the opposite parties for their wilful and deliberate disobedience of the order of this Court, whereby the District Magistrate, Rohtas at Sasaram was directed to take appropriate decision for grant of Arms Licence, if not already taken, within a period of 45 days from the date of receipt /production of a copy of this order.

A show cause affidavit has been filed on behalf of the opposite party o. 2 with a categorical averment that in pursuant to the order of this Court, the petitioner had also appeared before the concerned opposite party and upon receipt of the report and in the light of the guidelines laid down by this Court in the case of Manish Kumar Vs. The State of Bihar & Ors. (LPA No. 758 of 2018] as also the Arms Rules, 2016, the claim of the petitioner was considered. However, on being found no merit, the application of the petitioner has been rejected vide order dated 18.08.2020 passed in Arms Case No. 17 of 2020.

Having considered the rival submissions and also the order passed by the District Magistrate, Rohtas at Sasarm dated 18.08.2020, whereby the claim of the petitioner came to be turned down, this Court does not find any reason or occasion to continue with the present contempt proceeding. Accordingly, the same stands closed.

Suffice it to observe that the petitioner shall always be at liberty to assail the order whereby the claim of the petitioner stood rejected.
