Judgment
By Justice Rajiv Joshi, Member (Judicial)
Heard Shri Manoj Kumar Upadhyay, learned counsel for the applicant and Shri Chakrapani Vatsyayan, learned counsel for the respondents.
The instant Contempt Petition has been filed under Section 17 of the Administrative Tribunals Act, 1985 alleging non-compliance of the order dated 02.04.2025 passed by this Tribunal in Original Application No. 244 of 2025, whereby the O.A. was disposed of with the direction to the respondents to ensure the benefit of the order dated 09.01.2020 passed by this Tribunal in OA No.1005/2019 (Pradeep Kumar & others vs. Union of India & others) be given to the applicant as he is entitled to the same.
Learned counsel for the respondents submits that, in compliance with the aforesaid order dated 02.04.2025, the respondents have issued an order dated 10.04.2026 extending the benefit claimed by the applicant. The said order has been placed on record along with the compliance affidavit.
Learned counsel for the applicant, however, submits that pursuant to the grant of the aforesaid benefit, a revised Pension Payment Order (PPO) is also required to be issued in favour of the applicant, which has not been issued so far.
In reply to the same, learned counsel for the respondents, on instructions, undertakes that the revised PPO shall be issued to the applicant at the earliest.
We have considered the submissions advanced by learned counsel for the respondents and perused the compliance affidavit as well as the order dated 10.04.2026 issued by the respondents.
From the materials available on record, it is evident that the respondents have acted in compliance with the directions contained in the order dated 02.04.2025. The benefit granted to the applicant vide order dated 10.04.2026 is, however, subject to the outcome of any future judicial order in the matter. Insofar as issuance of the revised PPO is concerned, the undertaking given by learned counsel for the respondents is accepted. Thus, we are of the view that substantial compliance of the order dated 02.04.2025 has been made.
In view of the above, no further proceedings in the present Contempt Petition are called for. Accordingly, the Contempt Petition is closed and consigned to the record. Notices issued to the respondents stand discharged.
All pending M.As, if any, shall be treated as disposed of.
