Judgment
Heard Mr. Sanjay Bhatt, Advocate for the applicant and Ms. Mamta Joshi, Brief Holder, for the State of Uttarakhand.
The applicant is in jail having been implicated in FIR No. 649 of 2012 (Session Trial No.169 of 2013), which has been registered under
Sections 147, 148, 149, 302, 307, 120B/34, 174 of IPC, at Police Station- Kashipur, District-Udham Singh Nagar.
The first and second bail applications of the applicant have already been rejected by this Court vide orders dated 28.07.2014 & 08.09.2014
respectively. This is the third bail application of the applicant.
Considering the overall facts and circumstances of the case and the nature of offences, this Court is not inclined to enlarge the applicant on bail.
There is no new ground to enlarge the applicant on bail.
Accordingly, the bail application is hereby dismissed.
It is made clear that any observations made by this Court are only for the purposes of grant of bail. It shall not be taken into consideration at all
in any other proceedings.
