Mr. Justice L. Narasimha Reddy:

The applicant was selected and appointed as Assistant Section Officer (ASO) in Kendriya Vidyalaya Sangathan (KVS) and was posted at an Institution at Gwalior. It is stated that ever since then, he is at the same place. He made a representation dated 10.06.2020 with a request to transfer him to an Institution at Jaipur, where the post is said to be available. The applicant contends that the respondents have accommodated the requests of several persons vide orders dated 22.07.2019, whereas his request for transfer is not acceded to. He filed this OA with a prayer to direct the respondents to consider his request.

We heard Mr. Vipul Diwakar, learned counsel for applicant and Mr. R. Gowrishankar for Mr. S. Rajappa, learned counsel for respondents, at the stage of admission, through video conferencing.

The respondent-organization has its own policy and guidelines to be followed in the context of transfer of employees, be it on routine basis or on request. The circumstances under which various other employees are transferred on the request through order dated 22.07.2019, are not immediately before us. In case, the applicant fits into the guidelines in relation to the request transfer, his case also needs to be considered. The request cannot be kept pending indefinitely.

We, therefore, dispose of the OA directing the respondents to pass order on the representation of the applicant within four weeks from the date of receipt of copy of this order. There shall be no order as to costs.
