Petitioner has prayed for the following relief(s):

“I. For commanding the respondent authorities to take appropriate step to rescind the quiked action against the eleaget factor established and

product duplicate cement from damage/ expair cement Balajee enterprise Prof. Adhar No. 517665744822 and BR26B0015829.

II. For the commandant the respondent authorities pollution department quick action due to when start factory nose pollution and air pollution create

due to very problem on arrounded people.â€​

From the annexures and the correspondences annexed with the petition, it appears that activities, unauthorized in nature, of manufacture of cement is

being carried out by one M/s. Balaji Enterprise, not even arrayed as a party.

Be that as it may, we are of the considered view that interest of justice would be best met if the District Magistrate, Patna examines the issues and

takes appropriate action of venting out the grievances made by the petitioner and take necessary action within two months from the date of

receipt/communication of such representation along with a copy of this order.

As such, petition is disposed of reserving liberty to the petitioner to approach District Magistrate, Patna for redressal of grievances.

District Magistrate, Patna is directed to take necessary action within two months from the date of receipt/communication of such representation along

with of a copy of this order.

Needless to add, while considering such representation, principles of natural justice shall be followed and due opportunity of hearing afforded to the

parties.

Liberty reserved to the petitioner to approach the Court, if the need so rises subsequently on the same and subsequent cause of action.
