Judgment
This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
We have seen the note of the Superintendent in terms of our order dated 09.02.2023. We are constrained to observe that the reason as provided is entirely unacceptable. It shows that it was the failure of the system, as the system has not been calibrated properly. Transmission of the LCRs in the scanned PDF or other digital format is permitted. The digital file containing the digitalised LCRs shall be named by the case number of the High Court, in which the order for sending the records is passed.
In future, such explanation will not be entertained and it will be dealt seriously. As the mistake has been admitted, we are not passing any other consequential order.
It appears from the Registry’s note that the LCRs now have been placed on the records. It further appears from the Registry’s note dated 09.02.2023 that the notice has been served on the respondent, but none has entered in the appearance as yet.
Let the appeal be listed again on 05.04.2023. On that day, this appeal will be taken up for disposal on merit.
