Judgment

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
Learned counsels of both the sides are present.
In the previous order vide Order No.05 dated 07.11.2023, Registry was directed to call for the LCRs and to tag the same with the brief, but such order has not been complied.
It appears from the noting dated 15.11.2023 of the Registry that, in spite of repeated reminders given by this Court, the LCRs in the court of learned Civil Judge (Sr. Division), Talcher and learned Additional District Judge, Talcher have not been transmitted.
The District Judge, Talcher is directed to transmit the photo copies of the LCRs of the 2nd appeal, i.e., the photo copies of the records of C.S. No.180 of 2008 disposed of by the learned Civil Judge (Sr. Division), Talcher as well as the photo copies of the records of R.F.A. No.26 of 2014 disposed of by the Additional District Judge, Talcher within a week positively with a report about the cause of non-response to the repeated directions of this Court.
Registry is directed to send the copy of this order to the District Judge, Talcher for its compliance within the above stipulated period.
