CA(IB) No. 105/KB/2020 is filed u/s. 12A of the Code by the Operational Creditor for recording settlement of the dispute between the Operational Creditor and the Corporate Debtor praying for withdrawal of the CP. Being satisfied that CoC has not been constituted and settlement agreement has been entered into, as per Rule 11 of the NCLT Rules, 2016, this settlement can be recorded. According to the Ld. IRP no claim was received pursuant to publication of notice in newspapers. Therefore, we are recording the settlement of the claim of the Operational Creditor by the Corporate Debtor. It is further submitted that her fees and costs have been paid. Accordingly, this application deserves consideration. CA is disposed of accordingly.
In view of the above, CP is also disposed of. File is consigned to record.
