CA(IB) No. 1528/KB/2019 is an application filed by the IRP for recording settlement of the matter, permitting the Operational Creditor to withdraw the CP for the reasons that the matter was settled out of the Tribunal. CP was admitted vide order dated 16/10/2019 and CoC has not been formed as no claim has been received upon public announcement.
Having satisfied that the matter was settled out of the Tribunal and CoC has not been constituted and fees and costs of the IRP have also been discharged, CA is liable to be allowed. Hence, allowed and disposed of recording settlement. C.P. is also disposed of accordingly.
