 Arguments heard on the application filed under Section 439 of Cr.P.C. on 25.11.2020 on behalf of applicants Sunil Kushwah and Suresh Patil who
are confined in custody since 15/11/2020 in connection with Crime No. 216/2020 registered at Police Station Excise Circle, Section 7B Bhopal District
Bhopal for offences punishable under Sections 34 (1) and 34 (2) of M.P. Excise Act.
It appears from the record that total 63 bulk litres of liquor has been seized from the possession of the applicants.
Upon query, the State has given the information that as per the case diary, this is the first offence of both the applicants and they are not having any
criminal background.
In the aforesaid situation, looking to the overall circumstances of the case, the application is allowed. It is directed that the applicants shall be released
on bail on their furnishing a bail bond worth Rs. 30,000/- (Rupees Thirty Thousand only) each and a personal bond of the same amount to the
satisfaction of the trial Court.
It is directed that the applicants shall abide by the conditions as enumerated under section 437(3) of the Cr.P.C.
At the time of releasing from custody, all the instructions issued by the Government related to Covid-19 shall also be followed by the concerned
authority.
This application stands allowed.
