Judgment

Heard on application filed under Section 439 of Cr.P.C. filed on 21.10.2020 on behalf of Kunjilal Rajak and Manoj Yadav, who are confined in custody since 04.10.2020 in connection with the Crime No. 375/2020 registered at Police Station, Themi, District Narsinghpur for the offences punishable under Sections 34 (2) of M.P. Excise Act.
It appears from the record that total 54 bulk liters of country made liquor was seized from the joint possession of applicants on 04.10.2020. Upon query, it is submitted by the State that as per case diary there is no any criminal background of any of the applicant.
Therefore, looking to the first offence and the other circumstances of the case including quantity seized, without commenting on merits, the application is allowed. Both applicants namely, Kunjilal Rajak and Manoj Yadav be released on bail upon their furnishing a personal bond in the sum o f Rs. 30,000/- (Rupees Thirty thousand Only) each with one solvent surety of the like amount to the satisfaction of the trial Court.
At the time of releasing from custody, all the instructions issued by the government related to the Covid-19 shall also be followed by the concerned authority.
Accordingly, this M.Cr.C. stands allowed.
