Judgment
Hon'ble Mr. R. N. Singh, Member (J):
Shri T.D. Yadav, learned counsel for the applicant submits that the applicant has approached this Tribunal vide the present Original Application under Section 19 of the A.T. Act, 1985, with limited prayer that aggrieved by the appellate order dated 12.10.2020 (Annexure A-1), the applicant has preferred a Revision Petition dated 09.11.2020 (Annexure A-10). However, the same is still pending consideration of the respondents in spite of lapse of more than six months.
Issue notice. Shri K.K. Sharma, learned counsel, who appears for respondents on advance service, accepts notice.
Shri T.D. Yadav, learned counsel for the applicant submits that the applicant will be satisfied, if the present OA is disposed of, with a direction to the respondents to consider the applicant's aforesaid pending Revision Petition dated 09.11.2020 (Annexure A-10) and respond to the same in a time bound manner.
We are of the considered view that if a such request of the learned counsel for the applicant is accepted, no 3 OA No-1198/2021 prejudice is likely to be caused to the learned counsel appearing for the respondents.
In view of the aforesaid, without going into the merit of the case, the present OA is disposed of, with direction to the respondents to consider the applicant's aforesaid Revision Petition dated 09.11.2020 (Annexure A-10) and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within ten weeks of receipt of a copy of this Order.
The present OA is disposed of in the aforesaid terms. No costs.
