Judgment
Hon’ble Mr. Tarun Shridhar, Member (Administrative) : Shri Avinash Kumar Sharma and Shri Sunil, learned counsel for the applicant and Shri P.K. Rai, learned counsel for the respondents are present.
The present OA has been filed seeking the following reliefs :-
“(i)To issue order or direction in the nature of mandamus commanding the respondents to consider the application of the applicant and select in the selection list of Chief Loco Inspector and send to training for pre selection coaching.
(ii)To issue order or direction in the nature of mandamus commanding the Respondent No.3 to decide the representation dated 31.05.2021 (Annexure No.1).
(iii)Award the costs of the original application favour of the applicant.”
During the course of hearing on the earlier occasion, the learned counsel for the respondents was directed to inform the outcome of the result of the examination to us in sealed cover. Learned counsel has since complied with these directions and provided the necessary information.
We have gone through the said information which discloses that none of the applicants has been successful in the selection examination wherein 60% was the established Benchmark for qualification. Only one candidate named Shri Pritam Saurabh son of Shri Ayodhya has been successful in the said examination. The information has been furnished to us under the signature of a responsible officer of the department i.e. Senior Divisional Personnel Officer, Ijjatnagar and we have absolutely no grounds to doubt the veracity of the same.
In view of the developments and the information furnished before us, nothing sustains in the present original application and accordingly, the OA is dismissed. No order as to costs.
The letter of Senior Divisional Personnel Officer vide which the result was submitted to us is returned to the learned counsel for the respondents.
All the MAs associated with this original application stand disposed of as having become infructuous.
