MA No. 1479/2021
The present MA has been filed by the applicants seeking certain interim directions. Learned counsel for the applicants submits that during the pendency of the OA, the respondents have promoted certain persons vide order dated 13.03.2020, who were not even eligible for being considered or promoted in view of the relevant Recruitment Rules.
In the facts and circumstances, Mr. Yadav, learned counsel for the applicants seeks permission to withdraw the OA with liberty to the applicants to challenge the said order of promotion, if so advised, in accordance with law. Permission is granted.
In view of the aforesaid, the present OA is disposed of with liberty to the applicants as aforesaid. Pending MA also stands disposed of. No costs.
