Petitioners have challenged Clause 6 of the advertisement dated 30.07.2026, annexure-2 to the writ petition, whereby the upper age limit for appointment to the post of Veterinary Pharmacy Officer has been fixed at 42 years, as well as the mandamus to the respondents to consider the candidature of the petitioner by giving appropriate age relaxation for the post of Veterinary Pharmacy Officer.
It is the contention of the learned counsel for the petitioners that petitioners have passed Diploma in Pharmacy in the year 2003. He further contends that for the advertisement dated 30.07.2026, petitioners have become overage by two years, therefore, the said condition should be quashed and the State Government be directed to give relaxation in upper age to the petitioners.
Learned State Counsel supplied instructions dated 21.08.2026 to this Court, which are taken on record. On instructions, he submits that in the year 2012, 2016, 2019, 2022 & 2025, several advertisements were issued for filling the vacancy on the post of Veterinary Pharmacy Officer. Except for the year 2025, petitioners were within the eligibility as far as the age is concerned. Learned State Counsel submits that the Rules known as the Uttarakhand Services Recruitment (Age Limit) Rules, 2014, as amended up to date, prescribe the upper age limit for government service as 42 years and, accordingly, the advertisement was issued, and in Clause 6 of the advertisement, the upper age limit was so prescribed.
Having heard the rival contentions of learned counsel for the parties and having perused the record of the writ petition, this Court is of the view that no interference is warranted, as no right accrued in favour of the petitioners. Several advertisements were issued after the petitioners passed Diploma in Pharmacy. Accordingly, the writ petition is dismissed in-limine.
Pending application, if any, stands disposed of accordingly.
