Judgment

Petitioners are Degree Holders i.e. Bachelor in Pharmacy. They want their application to be considered for the post of Veterinary Pharmacy Officer. An advertisement was issued on 30.07.2026 inviting applications from eligible candidates on the post of Veterinary Pharmacy Officer. The last date of submission of application form was 12.09.2026.
In the advertisement candidate having following qualifications are eligible for submitting their candidature:-
(i)Pass in Intermediate Examination with Science as a subject from the Uttarakhand Education and Examination Board or Uttar Pradesh Secondary Education Board or any equivalent qualification recognized by the Government. In addition, those having High School qualification before the implementation of the Education Regulations, 1991 for Diploma Course in Pharmacy (as amended by the Education Amendment Regulations, 1994) of the Pharmacy Council of India in the State of Uttarakhand will also be eligible.
(ii)Candidate should be a Diploma Holder in Pharmacy (Allopathy) from a recognized institution.
Petitioners contend that the applications have only been invited from those candidates who are Diploma holder in Pharmacy (Alopathy) as per the advertisement, but the Degree Holders in Pharmacy have not been permitted to file the application.
Learned counsel for petitioners relied upon the notification dated 08.06.2026, whereby, the qualification of Degree in Pharmacy was included along with Diploma in Pharmacy for Pharmacy Officer.
Learned counsel for State as well as for the caveator submit that Regulation 2 of the Pharmacist Recruitment, Promotion and Service Regulation, 2025, is only attracted for the Pharmacy Services (Alopathic), and therefore, the same would not be attracted for the Veterinary Pharmacy Officer. It is further submitted by them that petitioners have filed the present writ petition after the last date of submission of application form pursuant to advertisement dated 30.07.2026. In such view of the matter, no case is made out in favour of petitioners.
Without expressing any opinion as to whether these Regulations are attracted to the Veterinary Pharmacy Officer or not or attracted only to the Pharmacist (Alopathy), this Court is of the view that since the petitioners have filed the present writ petition after last date of application form and also they have not challenged the advertisement dated 30.07.2026 and the condition thereto, therefore, no interference is warranted.
Accordingly, the present writ petition is dismissed in-limine.
Pending application, if any, stands disposed of.
