CA No. 167/2020 is filed by the applicant seeking urgent hearing of CA No. 168/2020. In the circumstances, CA No. 167/2020 is allowed and accordingly, CA No. 168/2020 is taken up for hearing.

The instant CA No. 168/2020 has been filed by respondent No. 1 i.e. M/s. Guild Builders Private Limited in CP No. 183/Chd/Hry/2018 seeking a direction against the petitioner No. 1 in CP No. 183/Chd/Hry/2018 i.e. Mr. Sunil Goel restraining him from pledging and/or alienating the shares held by him in respondent No. 14 in CP No. 183/Chd/Hry/2018 i.e. M/s. Omaxe Limited.

Heard the learned senior counsel Mr. Ranjit Kumar for the applicant, Mr. J Sai Deepak, the learned counsel for respondent in the CA and also Mr. Abhimanyu Bhandari, the learned counsel for respondent No. 2 in CP and Mr. Anirudh Bakhru, the learned counsel for respondent No. 14 in the CP.

We noticed that the Memo of Parties filed in the instant CA is not in order, hence, we direct the applicant to file a proper amended memo of parties in the CA by tomorrow i.e. 31.07.2020 after service on other side. On filing of the said amended memo of parties, let notices be issued to all the respondents as per the said amended memo of parties. The applicant shall take out the notices from the Registry and send the same by speed post immediately to the respondents at their registered addresses attaching therewith copy of the application and the entire paper book and the copy of this order.

The applicant shall file affidavit of service supported by postal receipt and tracking report before the next date of hearing.

The respondents may file their respective replies to the CA within one week from the date of receipt of the notice in the CA with a copy in advance to the counsel opposite. Rejoinder, if any, thereto may be filed within two days thereafter with a copy in advance to the counsel opposite. List the CA No. 168/2020 alongwith main CP No. 183/Chd/Hry/2018 on 11.08.2020. In the meanwhile, status quo shall be maintained with regard to the shares held by petitioner No. 1 (in CP No. 183/Chd/Hry/2018) in M/s. Omaxe Limited.
