Judgment
Ravindra Maithani, J
Applicant is in judicial custody in Case Crime/FIR No. 03 of 2024, under Sections 420, 467, 468, 471, 120B IPC, Police Station Pauri, District Pauri Garhwal. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
It is argued that co-accused Jignesh having similar role has already been granted bail. It is argued that, in fact, Rs.4 Lakh were transferred in the account of the applicant by the informant, but learned counsel would submit that the applicant and the informant were good friends and Rs.4 lakh had already been returned by the applicant to the informant, prior to the lodging of the FIR and that money has nothing to do with the instant FIR.
Learned State counsel would very fairly concede that it is a case of parity with the co-accused Jignesh.
Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
