Judgment
By Hon’ble Mr. Manish Garg, Member (J):-
In the present Original Application filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant seeks the following reliefs:
“(a)Directing the respondents to place the relevant records pertaining to the present O.A. before their Lordships for the proper adjudication in the matter in the interest of justice, and thereafter;
(b)Directing the respondents to consider and finalize the request/appeal of the applicant within some stipulated period pending in the shape of representations dt. 23.12.22 followed further on dt. 25.10.23 in the shape of reminders (Annexure A/1 (Colly.)} to accord the benefits of the law laid down by their lordships on dt. 09.11.21 in OA No.3628/13 titled as Dev Dutt Vs. UOI., OA No. 126/15 titled as Sanehad Central Administrative Tribunal& Ors. Vs. UOI decided on 02.12.21 as well as by a common order dt. 14.12.21 in O.A. Nos. 1121/2015 & Batch including by the Hon'ble Delhi High Court in WP(C) No. 544/24 on dt. 02.04.24 further reiterated by the Hon'ble CAT (PB), New Delhi in OA No. 1476/24 on dt. 09.04.24 with all other consequential benefits being extended to the batch mates of the applicant etc.
(c)Allowing the O.A. of the applicant with all other consequential benefits and costs.
(d)Any other fit and proper relief may also be granted to the applicants.”
Briefly stated, the applicant had applied for recruitment to various Group ‘D’ posts pursuant to Notification No. 220-E/OpenMkt./RRC/2012 issued by the Railway Recruitment Cell, Northern Railway, Delhi. He qualified the written examination and Physical Efficiency Test (PET) and thereafter appeared for Document Verification and Medical Examination, wherein he was found fit.
Subsequently, the applicant’s candidature was rejected on the ground of mismatch in handwriting/signature, based on the opinion of a Forensic Document Expert. The applicant challenged the rejection and, pursuant to the liberty granted by the Hon’ble High Court of Delhi, submitted representations to the respondents seeking consideration of his grievance.
It is submitted that the representations dated 23.12.2022 and 25.10.2023 submitted by the applicant are still pending consideration.
Heard learned counsel for the applicant as well as learned counsel appearing for the respondents.
With the consent of learned counsel for the parties, the present O.A. is taken up for disposal at the admission stage itself.
In view of the submissions made by learned counsel for the parties, and without expressing any opinion on the merits of the case, the present O.A. is disposed of with a direction to the respondents to consider and decide the representations dated 23.12.2022 and 25.10.2023 submitted by the applicant, in accordance with law, by passing a reasoned and speaking order within a period of 45 days from the date of receipt of a certified copy of this order.
Pending Miscellaneous Application(s), if any, shall also stand disposed of. There shall be no order as to costs.
