This MA is filed with a prayer to condone the delay of 87 days in filing the OA. It is stated that the delay is on account of the COVID-19 pandemic situation. Respondents filed a reply opposing the MA.

We are satisfied with the reasons mentioned in the MA. Accordingly, the delay is condoned and the MA is allowed.

The applicant responded to the advertisement issued by the DSSSB for selection to the post of Special Education Teacher with Post Code No.87/17. It is stated that the examination was held and the candidates who are in the zone of selection were required to upload their e-dossiers. The applicant contends that no information has been given to him about the uploading of e-dossier and it was only in July, 2019 that he came to know that the e-dossiers were required to be uploaded between 19.09.2018 to 28.09.2018. He filed this OA to permit him to upload his e-dossier or to hand over the documents. He contends that for no fault of his, the dossier could not be uploaded at the relevant point of time.

We heard Mr. Yashpal Rangi, learned counsel for the applicant and Ms. Esha Mazumdar, learned counsel for the respondents.

The entire selection process was through online. From the uploading of the application form, till the declaration of the final result, everything was online. Once the results of the examination were declared, the candidates within the zone of selection were required to upload their e-dossiers for the purpose of processing further. It is not in dispute that the respondents published a notice on 14.09.2018 requiring the candidates to upload their e-dossiers between 19.09.2018 and 28.09.2018. Here itself it needs to be mentioned that the applicant was required to check the website of the Board from time to time and then to take further necessary steps. The applicant did not take any steps in this connection and it was only in July, 2019 he came to know about it. By the time he came to know about it, six months have elapsed from the last date stipulated for uploading of the e-dossiers. Similar issue was dealt with by the Hon'ble Delhi High Court and following the same this Tribunal also dismissed OA No. 220/2020 holding that the negligence exhibited by a candidate cannot be helped at all, and the process cannot be reversed.

We do not find any merit in the OA and the same is accordingly dismissed. There shall be no order as to costs.
