Suman Gupta vs State of J&K and ors

The petitioner claims to be at serial No. 112 of the latest seniority list of Asstt. Surgeons/MOs of the Health and Family Welfare Department. The grievance projected by the petitioner is that persons junior to her have already been promoted but the case of the petitioner for next promotion to the post of Block Medical Officer has not been considered. She, however, claims that she has already represented her case before Hon''ble Minister of Health and Medical Education Department who vide his endorsement made on the representation dated 04.12.2017 has asked the respondent No. 3 to look into the matter and accord sympathetic consideration.

In view of the aforesaid submissions, learned counsel for the petitioner states that he would feel satisfied if this petition is disposed of at this stage by directing the respondents to consider the representation made by her on 04.12.2017 and endorsed by the Minister of Health and Medical Education Department on the same date and pass appropriate order of her adjustment also on the higher post of Block Medical Officer on the analogy of her juniors.

In the aforesaid facts and circumstances, this petition is disposed of by directing the respondent No. 1 and 3 to consider the claim of the petitioner for her promotion to the post of Block Medical Officer or equivalent as projected by her in her representation dated 04.12.2017 and endorsed by the Minister of Health and Medical Education Department, J&K on the same date. Let a decision in this regard be taken by respondent No. 2 and 3 within four weeks from the date certified copy of this order is made available to them by the petitioner.
