Prashant Kumar, J.—Bail application filed by petitioners Sukar Mahto, Huli Mahto @ Holi Mahto and Dinoo Yadav @ Dineshwar Yadav @ Dinesh Yadav is moved by Sri Rajendra Krishna, learned counsel for the petitioners and opposed by Sri S.P. Jha, learned Additional PP. and Sri Srinivas Roy, learned counsel for the informant. In the first information report there is omnibus allegations against all accused persons that they assaulted deceased and other persons. However, from perusal of statement of one of the injured at paragraph No. 52 of the case diary, it appears that main assailant of deceased are Dasho Mahto and Nandlal Mahto. Petitioners implicated in this case taking aid of Section 149 of the Cr. P.C.

Considering the aforesaid facts and circumstance and specially taking into account that petitioner No. 1 & 2 are in custody from 31.01.2012 and petitioner No. 3 is in custody from 13.01.2012, I allow this application and direct the court below to enlarge the petitioners, above named, on bail on their furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of like amount each to the satisfaction of Shri N. Kumar, Judicial Magistrate, Giridih in connection with Jamua P.S. Case No. 01 of 2012 corresponding to G.R. No. 14 of 2012.
