This M.A has been filed seeking extension of time for filing the final report in compliance of the order dated 09.10.2023 passed by the Tribunal in OA No. 610/2023. The application does not disclose as to who has filed this application but learned counsel pressing the application has submitted that this application has been filed by the Himachal Pradesh State Pollution Control Board (HP SPCB). Before the Tribunal in OA No. 610/2023, the issue was raised that the National Highways Authority of India (NHAI) was constructing a four-lane highway from Kiratpur to Manali and Pathankot to Mandi in flood prone area especially close to the Beas River. The Tribunal considering the issue of construction on the floodplain area, had constituted a Joint Committee with Member Secretary, HP SPCB as the nodal agency and had required the Joint Committee to submit the report before the Tribunal within eight weeks.

Pressing the M.A, learned counsel for the applicant submits that all the information has been collated from the concerned agencies and out of the five sections i.e. Kiratpur - Nerchowk, Nerchowk – Pandoh, Pandoh – Takoli, Takoli – Kullu and Kullu – Manali, the information relating to the first two sections have been received and the information is being collected in respect of the remaining three sections and this exercise will be completed and report will be filed within three months.

It has not been disclosed in the M.A as to how the floodplain zone of the river has been demarcated and no map or details of demarcation of floodplain zone have been placed on record. Hence, the Joint Committee will duly look into this issue also.

The Prayer is allowed and time granted by the Tribunal by the order dated 09.10.2023 passed in OA No. 610/2023 is extended by three months from today.
