Judgment
Arindam Lodh, J
Heard Mr. S. Bhattacharjee, learned counsel for the accused-applicant. Also heard Mr. Ratan Datta, learned PP assisted by Mr. S. Debnath, learned Additional PP appearing for the respondent-State.
The applicant has filed the present application for granting him anticipatory bail as provided under Section 438 Cr.P.C., who is apprehending arrest in connection with Teliamura PS case No. 40 of 2022 registered under Sections 489A/489B/489C/420/120B of the IPC.
Mr. Bhattacharjee, learned counsel for the accused-applicant has submitted that the accused-applicant is totally innocent and out of political rivalry the earlier accused persons have implicated him in the present case.
Learned PP has submitted that 4 (four) accused persons relating to the instant case were already arrested with some fake currencies. All the accused persons were enlarged on regular bail, but, one of the accused persons had jumped the bail conditions, and as such, he was again taken into custody. According to the prosecution, though the accused persons disclosed the name of the present accused-applicant during the course of interrogation, but, they did not collect the fake currencies from the possession of the accused-applicant, Sudiram Molsom.
After hearing learned Public Prosecutor, I direct the accused-applicant, namely, Sudiram Molsom to appear before the Investigating Officer, S.I. Sujit Sarkar (Crime Branch, Agartala, West Tripura) tomorrow itself i.e. 20.10.2023 at 11:30 a.m.
However, I am inclined to release the accused-applicant on interim bail. Accordingly, the accused-applicant may be released on anticipatory bail on furnishing a bond of Rs. 1,00,000/-(Rupees One lakh) with one surety of the like amount to the satisfaction of the arresting authority.
It is directed that the accused-applicant shall co-operate with the Investigating Officer in all respect. The Investigating Officer is at liberty to interrogate the accused-applicant in any manner whatsoever in accordance with law. If the Investigating Officer finds that the accused-applicant is not co-operating with the investigation process, then, he may approach the competent court praying for cancellation of this bail order through learned Public Prosecutor.
The instant application stands allowed in the above terms.
