By way of the present OA, the applicant is seeking direction to the respondents to immediately restore and release the entire withheld/stopped salary of the applicant along with all consequential and admissible allowances, from the date of stoppage till date with interest @ 12 % per annum on the delayed payment and direct the respondents to issue appropriate order/direction to make the regular payment of monthly salary due and admissible to the applicant.

The learned counsel for the applicant after arguing for some time submits that the respondent No. 03 has issued a clarification regarding the service particulars of the applicant vide communication dated 14.07.2026 (Annexure A-18) and the applicant would be satisfied if direction is issued to the respondents to consider the reply to the said communication dated 14.07.2026 (Annexure A-18) and take a decision in a time bound manner.

Issue notice to the respondents. Mr. H.A. Khan, the learned counsel appears on advance service, accepts notice and service of notice to the respondents is waived off.

The learned counsel for the respondents submits that the applicant may be directed to submit the requisite documents sought vide communication dated 14.07.2026 (Annexure A-18) and on reply to the said communication dated 14.07.2026, decision shall be taken by the respondents in a time bound manner.

Heard with consent. We have considered the matter.

In view of above, without expressing any opinion on the merits of the case, we deem it just and proper that principles of natural justice would be met and hereby grants liberty to the applicant to submit reply/clarification pursuant to the communication dated 14.07.2026 (Annexure A-18) within a period of seven days from the date of receipt of certified copy of order passed today and same shall be considered by the respondents/competent authority as expediently as possible preferably within a period of four weeks from date of receipt of such reply/clarification to communication dated 14.07.2026 (Annexure A-18), if so filed by the applicant by passing a reasoned and speaking order.

Needless to say, we have not expressed any opinion on the merits of the case and respondents are free to consider the reply/clarification, if so filed in accordance with law, without being influenced by the order passed today.

If the applicant is found entitled to the salary, same shall be disbursed forthwith.

In view whereof, the present OA stands disposed of at admission stage itself in above indicated terms.

Pending MA(s), if any, also stands disposed off.

However, there shall be no order as to costs.
