Judgment
Per: Dr. Lata Baswaraj Patne, Judicial Member.
The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act 1985, praying for the following relief(s):-
“A. Grant of seniority and consequential service benefits pursuant to delayed compassionate appointment from 18.04.2018.
B. Grant any other relief which this Hon’ble Tribunal may deem fit and proper in the facts and circumstances of the case”.
Ld. Counsel for both sides are present and are heard.
When the matter has been taken up for consideration, Ld. Counsel for the applicant submits that the applicant who is an adopted son, have granted the compassionate appointment. However, the respondents have not considered his claim to grant the seniority w.e.f, 18.04.2018. Therefore, he has submitted a detailed representation. The same has not been considered and still pending before the respondent competent authority, i.e, on 15.12.2025.
Considering the submission made by Ld. Counsel for the applicant without going into the merits of the case with limited relief, the respondents are directed to examine and consider the representation of the applicant in accordance with rules/laws within a period of 03 months from the date of receipt of a certified copy of this order. However, law of limitation is kept open.
The Original Application is accordingly disposed of. There will be no order as to costs.
