Judgment
Having heard learned Counsels of either parties, it transpires that this is an appeal for enhancement of compensation. Accident occurred on 2.7.2005 at 3 PM when Sudesh Pal Malik, aged 46 years, was going on his scooter no. UGY-3488, was dashed by the car no. HR-26U- 3606. Mr. Malik suffered several injuries. So, he was admitted in the hospital on 2.7.2005 and was discharged from there on 5.7.2005. Mr. Malik filed a claim petition no. 13/2007 claiming compensation of Rs. 21,50,000/-, while the learned Tribunal granted Rs. 12,255/- along with 7 per cent simple annual interest.
It has been argued on behalf of the appellant that at least rupees one lakh was spent in his treatment. However, I feel that the entire bills which were reliable and issued from the premier institutions like Jollygrant Hospital have been directed to be paid in full by the learned Tribunal. No disability certificate was ever produced. Appellant remained admitted only for three days in the hospital.
Considering the facts and circumstances and the materials on the record, I have not been persuaded to take a different view that what has been taken by the learned Tribunal.
Appeal is hereby dismissed. Let the LCR be sent back.
