Judgment
Lisa Gill, J.—This appeal has been filed by the appellant claiming enhancement of compensation granted him on account of injuries suffered by him in an accident which took place on 18.09.1998.
The appellant is stated to have suffered the following injuries as per the Medico Legal Report (Ex. P-2):-
Lacerated wound 7cm x 2 cm skin deep on the left parietal region.
Reddish color abrasion on left eye brow 2 cm x 1 cm.
A lacerated wound just below left eye 1-1/2 cm x 1cm.
Reddish abrasion on right hand 2 cm x 1 cm.
An abrasion 1 cm x 1 cm on the left hand middle knuckle.
An abrasion on front of both knee and joint.
An abrasion 1 cm x 1 cm over nose.
A lacerated wound on back of right scapula 5 cm x 1.5 cm.
A lacerated wound just below injury No. 8, 6 cm x 3 cm x 2 cm.
An abrasion over the right side of the face, 4 cm x 3 cm.
The Tribunal has awarded a sum of Rs. 10,000/- as compensation i.e. Rs. 9,000/- on account of pain and suffering and for loss of amenities of life and Rs. 1000/- for his treatment.
It is submitted by learned counsel for the appellant that the appellant is entitled to compensation of Rs. 50,000/- because he remained admitted in a private hospital for a period of 15 days and the Tribunal has not granted anything on that account.
On a pointed query, the learned counsel for the appellant has fairly stated that there is no evidence on record except the petitioner's statement to show that the appellant had been admitted in any private hospital. Further-more no bill, receipt what-so-ever has been produced by the claimant to show any expenditure incurred by him on the treatment of the above mentioned injuries which are admittedly abrasions and lacerated wounds. There is no evidence to show that the appellant suffered any permanent damage by way of even a scar etc., on his face or otherwise or which has in any manner affected his life. The appellant claims to be an agriculturist and there is nothing to show that he has suffered any loss of income due to the said abrasions and lacerated wounds.
In view of the above, I find no infirmity in the impugned award dated 09.09.2000. Consequently, this appeal is dismissed with no order as to cost.
