Judgment
Pradeep Kumar, Member (A):
1) The applicant herein is working as a Nursing Officer in one of the Government Hospitals under GNCTD. She was suspended on 17.10.2013 as a Criminal case was launched against her. This case ended in her acquittal by the competent court on 17.8.2019. Thereafter, this suspension was revoked on 26.09.2019 and she joined for duty with effect from 30.09.2019.
2) The applicant is aggrieved that during this period of such suspension, the 7th CPC came into force wef 1.1.2016, and despite her representations, this revision of pay was not granted to her. Certain other arrears also for suspension period, are also said to be not paid. This OA is in respect of these grievances.
3) Ms Esha Mazumdar, learned counsel, who appears on advance information for respondents, accepts notice. She further mentions that papers in respect of said grievances of the applicant, have since been processed and it may take some time to resolve the issue. She seeks time to submit the reply.
4) Matter has been heard.
5) The Tribunal is of the view that since action for resolution is currently underway, no useful purpose will be served by keeping this OA pending.
6) In view of foregoing, the Tribunal disposes of the instant OA, with direction to the respondents to decide on the said grievances of the applicant, within a period of 6 weeks under advice to the applicant. If as a result of such consideration, certain payments including arrears are found to be due, the same shall be paid to the applicant within further six weeks. The applicant will be at liberty to approach the Tribunal, if some grievances still subsist. No costs.
Pending MA, if any, stands disposed of accordingly.
