Heard. In this case, the petitioner is aggrieved with the impugned order of suspension dated 2.3.1989 as contained in Annexure I to this application. His submission is that a departmental proceeding has been initiated pursuant to the Charge-sheet as contained in Annexure 2 to this application dated 29.1.1990, but till date the same has not been concluded.

From perusal of Annexure 3 it appears that the disposal of the departmental proceeding has been delayed due to non-cooperation of the petitioner with the enquiry Officer.

It has been submitted on behalf of the petitioner that he has always cooperated with the departmental proceeding.

Be that as it may, since the departmental proceeding is pending, we are not inclined to interfere with the impugned order. However, it is directed that the departmental proceeding against the petitioner shall be concluded within three months from the date of communication of this order. It is made clear that if the petitioner does not cooperate with the departmental proceeding, it shall be disposed of ex-parte within the said period. If the departmental proceeding is not concluded within the said period, the order of suspension of the petitioner shall stand revoked automatically, if not already revoked. With the above observations/directions this application is disposed of.
