Judgment

Applicant has filed this application for grant of temporary bail u/s 483 of B.N.S.S. who has been arrested on 23.09.2025 in connection with Crime No. 522/2025 registered at Police Station - Chola Mandir, District Bhopal for the offence punishable under Section 34(2) of M.P. Excise Act.
It is submitted by learned counsel for applicant that son of applicant has expired on 30.12.2025 and applicant is required to perform last rituals. The factum regarding death of son of applicant has been verified by the State. Therefore, it is prayed that applicant be enlarged on temporary bail for the appropriate period.
Looking to the facts and circumstances of the case, temporary bail application is allowed and applicant be released on temporary bail till 15.01.2026.
It is directed that the applicant be released on temporarily bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the Trial Court.
It is directed that applicant shall surrender immediately on 16.01.2026 before the concerned trial Court. Counsel for the applicant is also directed that when applicant will surrender before concerned Competent Magistrate, certified copy of the order sheet of the concerned Competent Magistrate regarding his surrender shall be filed by him. Further, the surrender report of the applicant shall be submitted by the concerned Competent Magistrate to the Registry of this Court for information.
It is also directed that if applicant fails to surrender on the said date, the concerned Competent Magistrate shall take appropriate steps for securing his arrest.
Accordingly, the bail application is disposed off.
