Judgment

Submissions were made in this first temporary bail application under Section 439 of Cr.P.C. for grant of temporary bail in connection with Crime No.42/2021 under Section 34 (2) of M.P. Excise Act registered at Police Station - Sitamau, District-Mandsaur and is in custody since 19/01/2021.
This temporary bail has been sought on the ground of marriage of daughter of the applicant, which take place on 19/03/2021.
Factum of marriage was sought to be verified and the fact has been verified by Penal Lawyer for the State.
Considered.
After due consideration the aforesaid facts and circumstances of the case in totality, without commenting on merits of the case, the application is allowed. It is directed that the applicant be temporarily released for a period of Ten Days, upon his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of the trial Court. It is made clear that the applicant shall surrender before the trial Court on expiry of period of Ten days from the date of his release and the trial Court shall submit surrender report thereafter
The High Court Of Madhya Pradesh before this Court. It is also made clear that that if he is found indulged in any other offence also, his bail shall be treated as cancelled.
Accordingly, this application stands disposed of finally. C.C. today as per rules.
