This matter is taken up through hybrid mode.
Heard learned counsel for the petitioners and learned Addl. Standing counsel for the State.
The petitioners are apprehending arrest in connection with Khandapada P.S. Case No. 229 of 2023 corresponding to G.R. Case No.224 of 2023 pending in the court of the learned JMFC, Khandapada for the alleged commission of offence under Sections 427/341/294/323/324/307/354/506/34 of IPC.
It is alleged that the petitioners abused the informant in obscene language and also assaulted him causing injuries.
Considering the nature of accusations and also the materials on record, I am not inclined to grant anticipatory bail to the petitioners. The ABLAPL is however, disposed of granting liberty to the petitioners to surrender before the court below within a week from the date of receipt of certified copy of this order and to move for bail. In such event, they shall be released on bail on such terms and conditions as the court below may deem fit and proper to impose subject to verification of the statement that the co-accused persons have been released on bail.
The ABLAPL is accordingly disposed of.
