This matter is taken up through hybrid mode.
Heard learned counsel for the petitioners learned counsel for the State.
The petitioners are in custody in connection with Digapahandi P.S. Case No. 158 of 2023 corresponding to G.R. Case No. 844 of 2023 pending in the Court of learned S.D.J.M., Berhampur for the alleged commission of offence under 341/427/386/506/34 of IPC.
It is alleged that the petitioners and some other persons entered into the poultry farm of the informant and demanded money. When he refused, they ransacked the place and damaged vehicles and other articles including eggs of the poultry farm. It is submitted that in so far as investigation is concerned, practically nothing further remains to be done. The petitioners are in custody for nearly one and half months. They are local residents and therefore, the chance of their absconding is bleak.
Considering the submissions as above, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail.
Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial court on each date of posting of the case without fail.
The BLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
