Judgment
The lawyers have no objection with regard to the proceeding, which has been held through video conferencing today at 11:00 A.M. They have no complaint in respect of the audio and video clarity and quality.
The petitioners are directed to remove the defect in relation to court fees within two weeks by depositing the same. Rest of the defect as pointed out by the office is ignored for the present.
Heard the counsel for the parties.
The petitioners are accused for the offence punishable under Section(s) 188, 269, 270, 271 of the Indian Penal Code, Sections 12 and 13 of the Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005 and Section 11 of the Prevention of Cruelty to Animal Act.
The petitioners are in custody since 20.4.2020 and chargesheet has been submitted in this case. The name of the petitioners has transpired on the basis of confessional statement of co-accused Maqbul Ansari and Belal Ansari. The aforesaid co-accused have confessed that the petitioners were involved in selling the bovine animal.
Learned A.P.P opposes the prayer for bail of the petitioners. Considering the period of custody of the petitioners and the fact that the charge-sheet has been submitted in this case, I am inclined to release them on bail. Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1 st Class, Jamshedpur, in connection with Kamalpur P.S. Case No. 12/2020.
